These Website Terms of Use ("Terms") govern your access to websites, landing pages, webinar registrations, consultation calendars, forms, questionnaires, and related digital services operated by Global Premier Real Estate Agency, LLC ("Global Premier," "we," "us," or "our"). By accessing or using the services, you agree to these Terms. If you do not agree, do not use the services.
1. Eligibility and Permitted Use
You must be at least 18 years old to request real estate brokerage services or enter a binding agreement. You may use the services only for lawful, personal, or legitimate business purposes and in accordance with these Terms.
2. Informational and Educational Content
Website, webinar, newsletter, social-media, property, market, and educational content is provided for general informational purposes. It is not legal, tax, accounting, lending, appraisal, engineering, investment, or other professional advice. You should consult appropriately licensed professionals regarding your circumstances.
3. No Brokerage or Agency Relationship Through Website Use
Using a website, registering for a webinar, completing a form, requesting information, or booking a consultation does not by itself create a broker-client, agency, fiduciary, or representation relationship. Any brokerage relationship must be established through an applicable written agreement and disclosures. Communications submitted through the services are not confidential unless a written relationship or applicable law provides otherwise.
4. Real Estate Information and Listing Data
Property descriptions, listing data, availability, pricing, measurements, school information, taxes, zoning, permits, insurance information, photographs, maps, and market statistics may come from sellers, public records, multiple listing services, vendors, or other third parties. Information may change, contain errors, or become outdated. Users must independently verify information material to a decision.
5. Home Valuations and Strategy Reports
Any home valuation, comparative market analysis, broker price opinion, range, or strategy report is an estimate based on available information and professional judgment. It is not a guarantee of sale price, time on market, financing, insurability, or transaction outcome, and it is not an appraisal unless expressly identified as one and prepared by a licensed appraiser.
6. Webinars, Consultations, and Registrations
Registration information must be accurate and current. Webinar schedules, speakers, topics, formats, and access methods may change. We may reschedule, modify, limit, or cancel a webinar or consultation when reasonably necessary. Recording, copying, rebroadcasting, or distributing webinar or consultation content without written permission is prohibited.
7. Communications
By providing contact information, you authorize service-related communications concerning your inquiry, registration, appointment, questionnaire, or requested report. Marketing communications are governed by your consent and applicable law. You may unsubscribe from marketing email or reply STOP to eligible text messages. Consent to marketing communications is not a condition of purchasing goods or services.
8. Intellectual Property
The services and their content, including text, graphics, logos, photographs, videos, webinar materials, reports, guides, designs, trademarks, and software, are owned by or licensed to Global Premier and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to use the services for their intended purpose. No content may be copied, modified, sold, republished, scraped, or commercially exploited without written permission.
9. User Submissions
You represent that information and materials you submit are accurate, lawful, and yours to provide. You grant us permission to use submitted information as reasonably necessary to respond, provide requested services, prepare reports, maintain records, and operate our business, subject to our Privacy Policy. Testimonials, photographs, or promotional materials will be used publicly only with appropriate permission.
10. Prohibited Conduct
• Interfere with service security, availability, or normal operation.
• Attempt unauthorized access to accounts, systems, data, or administrative areas.
• Submit false, misleading, unlawful, infringing, harmful, or malicious content.
• Use automated tools to scrape, harvest, copy, or overload the services without written permission.
• Impersonate another person or use the services to send spam or unlawful solicitations.
11. Third-Party Services and Referrals
The services may link to or integrate with third-party platforms and may identify real estate professionals, lenders, title or closing providers, inspectors, contractors, vendors, or referral partners. Third parties are independent and responsible for their own services, terms, licenses, advice, and privacy practices. You are responsible for evaluating them. Where permitted by law, Global Premier may receive a referral fee or other compensation, which will be disclosed when required.
12. Fair Housing and Equal Opportunity
Global Premier supports equal housing opportunity and conducts its business in accordance with applicable federal, state, and local fair-housing laws. We do not intend for any content or service to express an unlawful preference, limitation, or discrimination.
13. No Guarantees
Real estate markets and transactions involve risk and circumstances outside our control. We do not guarantee that a property will sell, that a buyer will obtain financing, that a transaction will close, or that any user will achieve a particular financial or business result. Any examples or testimonials describe individual experiences and are not promises of future performance.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted access, error-free content, complete security, or that defects will be corrected. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, Global Premier and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption arising from use of or inability to use the services. Nothing in these Terms excludes liability that cannot lawfully be excluded.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold Global Premier harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the services, your violation of these Terms, or content you submit. This obligation does not apply to the extent a claim results from Global Premier's own unlawful conduct.
17. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect personal information. It is incorporated into these Terms by reference.
18. Changes, Suspension, and Termination
We may update the services or these Terms, or suspend or terminate access, when reasonably necessary for business, legal, operational, or security reasons. Updated Terms become effective when posted unless a later date is stated. Continued use after the effective date constitutes acceptance.
19. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute not otherwise governed by a separate written agreement must be brought in a court of competent jurisdiction in Florida, subject to applicable law.
20. General Provisions
If any provision is found unenforceable, the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement concerning use of the digital services, except that a separate written brokerage, service, purchase, or other agreement controls if it conflicts with these Terms.
